1.0 Subtantive PA CLE Credit
For credit outside of PA, you will be issued a certificate of completion to submit to your state's CLE board.
Presented by: Chaim Saiman, Professor of Law, Chair in Jewish Law, this CLE will review contract law’s traditional response to unforeseen circumstances embedded in the common law doctrines of impracticability and frustration of purpose. It will also examine the interpretation of force majeure clauses, focusing on how different language is read and the interaction between contractual language and the background common law rules, as well as consider whether these doctrines may operate differently in the context of a widespread pandemic, specifically looking at how reliance and restitution principles may be used to promote more loss sharing between the parties than the all or nothing approach conventional applications favor. It will conclude with some discussion of business interruption insurance and how decisions made in that arena may impact on contract law.
